1. Introduction

The following Terms and Conditions of Travel (CoT) apply to all adventure trips of the LegionnaireMind brand  (hereinafter "we" or "Supplier") and form part of the travel contract between you ("Participant") and the Supplier.

Our trips are not package tours, but extreme ventures in remote regions. They require discipline, physical and mental strength as well as the willingness to consciously accept risks. With your booking, you accept these terms and conditions bindingly.

2. Character of the voyages

Our adventure tours are fundamentally different from classic trips:

  • uncertain course and uncertain outcome,

  • extreme physical and mental stress,

  • Conscious renunciation of tourist standards (especially hygiene, transfers, route protection, accommodation, catering)

  • increased risk due to nature, climate, lack of infrastructure, medical care and local security situation.

By participating, you confirm your understanding and explicit consent.

2.1 Transports

Transportation is done by local means, on foot or anything that moves. Comfort and safety according to Western standards are not guaranteed and are often significantly undercut.

2.2 Paths & surroundings

We move off the beaten track. Risk of falling, rivers, jungles, deserts or similar risks are part of the trip.

2.3 Accommodation

Accommodation can be locally traditional accommodation, tents, mountain, wooden or hiking huts or the open sky.

2.4 Food

Catering is based on food available on site. Quality, hygiene and quantity do not meet Western standards. Allergies, intolerances or special requests cannot be taken into account. Water may be obtained and treated from the available sources or rivers, but a residual risk remains. No liability is assumed.

2.5 Hygiene

Sanitary facilities are hardly available and can deviate greatly from Western standards. This applies not only to food storage but also to personal hygiene. Personal hygiene may be carried out in rivers or by improvised means.

2.6 Medical care

First aid is only provided within the scope of our possibilities. Each participant is obliged to carry his or her own first-aid kit. In the event of a medical emergency, medical care, evacuation and rescue are not guaranteed.

2.7 Local partners

Cooperation partners are selected based on experience, not on international licenses. In many cases, you can rely on local guides or local locals who are familiar with the area.

2.8 Risk & Difficulty

The adventures involve increased risks (injury, illness, permanent damage, death). With your booking you declare your explicit consent.

2.9 Activities

Various activities can be carried out as part of the adventure trips. These include, but are not limited to: rafting, mountaineering, via ferrata, rock climbing, abseiling, ice bathing, horseback riding, hunting, sports units, trail running, martial arts, paragliding, canoeing and much more.

Each of these activities involves significant risks and is entirely at the participant's own risk.

3. Travel contract

The contract is concluded with our confirmation and the issuance of our invoice. By making the initial payment, the client acknowledges and accepts our Terms of Service. We reserve the right to reject or exclude participants if they are unsuitable, or if the participation fee has not yet been paid in full.

4. Payment

Deposit upon booking:

  • 30% of the price if booked more than 90 days before the start of the trip

  • 50% of the price if booked less than 90 days before the start of the trip

  • 80% of the price if booked less than 60 days before the start of the trip

Interim payment:
60 days before the start of the trip, 80% of the tour price is due.

Final payment:
The remaining amount must be paid at least 30 days before the start of the trip without further request.

Non-payment:
If 100% of the payment is not made 30 days before the start of the trip, we reserve the right to cancel the contract and allocate the travel place to another person. In this case, amounts already paid can be withheld.

5. Services

Scope of services results exclusively from the final travel information. Changes for reasons of safety, force majeure or organization are possible at any time and sometimes deliberately wanted to make the experience more eventful.

6. Changes in services

Unpredictable geographical conditions and general uncertainties are an integral part of our adventure trips. As a participant, you must be aware that routes, procedures and exploration routes can change at any time if the location or weather conditions require it. Flexibility – individually as well as in a team – is therefore crucial and has a significant influence on who becomes part of our expeditions. Deviations are to be expected, especially in previously undeveloped regions or during first expeditions. In addition, there are possible events such as force majeure, natural disasters, failure or loss of equipment, conflicts with local populations, government orders or the withdrawal of transport and landing rights. Illnesses or injuries of participants or team members can also make adjustments necessary. In addition, inadequate or missing infrastructure, technical problems or weather-related obstacles (e.g. flooding after heavy rainfall) can force change. These circumstances can affect accommodation, food and the entire route. In extreme cases, the desired destination cannot be reached or the expedition can be ended prematurely. The aforementioned imponderables or route changes can lead to individual program items being postponed or cancelled - up to and including an extension of the entire trip. Despite careful planning, it cannot be ruled out that the originally planned end date will also change. As a participant, you are therefore obliged to plan buffer days for your return journey to avoid complications.

7. Obligations to cooperate

Each participant is expected to prepare carefully and independently for the expedition. This includes in particular:

  • independent information on security and entry regulations of the destination area,

  • ensuring sufficient physical and mental fitness.

During the expedition, the running pace set by the guides or us applies - this is binding and must be adhered to by all participants.

8. Refund

Withdrawal/ cancellation by the participant is possible at any time in writing. Cancellation:

  • up to 6 months before the start: 30 %

  • up to 3 months before the start: 50 %

  • 60-30 days before the start: 80 %

  • 29–7 days before the start: 90%

  • from 6 days or no-show: 100 %

After the start of the journey, refunds are excluded, particularly but not limited to the following cases:

  • Injury, withdrawal, evacuation, death, or exclusion of the participant, and

  • Changes in itinerary or activities.

Especially due to force majeure or circumstances beyond our control. This also includes safety measures taken to prevent potential dangers. We recommend travel interruption and cancellation insurance.

9. Force majeure

If force majeure significantly endangers the trip or if a safe implementation is doubtful (natural disasters, political conflicts, etc.), we can cancel or postpone the trip before the start of the trip. If the trip has to be interrupted during the implementation in order to ensure the safety of the participants, additional costs for the return journey and additional services such as accommodation and meals must then be borne by the participant. Refund or credit is at our discretion.

10. Minimum number of participants

The trips will take place in any case. The smaller, the more exclusive the experience.

11. Exclusion of participants

Exclusion is possible in the event of:

  • Indiscipline

  • endangering others,

  • Disobeying instructions.

The costs for return travel and evacuation are borne by the participant.

12. Special costs

Additional costs for medical services, evacuation, repatriation, return flights, restaurant visits, accommodation before the official start of the event, tips and personal equipment are borne by the participant himself.

13. Liability

Participation in all trips and activities of LegionnaireMind is entirely at the participant's own risk. This includes in particular:

  • voluntary participation in all activities (physical, mental, athletic, challenging),

  • the intake of food and water,

  • the health consequences that may arise in connection with climate, physical exertion or food,

  • all risks of illness, injury, permanent damage or death.

The participant expressly declares that he is aware of the risks and that he bears them in full responsibility. Liability on the part of the provider – even in the event of injury, illness or death – is excluded, unless mandatory statutory provisions to the contrary.

14. Assignment of Contract

Until the start of the trip, a substitute participant can be provided, provided that he or she is suitable. Nevertheless, you remain jointly and severally liable to pay the travel price together with the substitute participant.

15. Content Use

Material created during the trips (photos, videos, reports) may be used by us. Private and commercial use by participants is allowed as long as it is not used for competition purposes or discrediting LegionnaireMind.

16. Choice of Law & Place of Jurisdiction

The law of the United Arab Emirates shall apply exclusively to the contractual relationship. The place of jurisdiction for all disputes is Dubai, UAE.

17. Modification of the Terms

We may update this CoT at any time. The current version will be made available upon request or announced by official communication. Further participation is considered acceptance of the updated version.

18. Confirmation of Terms

By registering for a trip, you confirm that you have read, understood and accepted these General Terms and Conditions of Travel. You enter into a binding agreement with the following company:
